sale GENERAL INFORMATION
Welcome to our website www.impasse-des-parfums.com Impasse des parfums is a
trademark owned by Impasse des parfums.
We take great care to ensure that all information published on our Site is accurate and up-to-date.
We reserve the right to correct the content of our Site at any time without prior notice.
However, we cannot guarantee the accuracy, precision or completeness of all the information on
our site, which is why we decline all responsibility resulting from fraudulent intrusion by a third
party leading to modification of the information made available on the site, and more generally for
any damage, direct or indirect, whatever the causes, origins, natures or consequences, caused
by the access of whoever to the site or the impossibility to reach it of the use of the Site and³ the
credit granted to some information coming directly or indirectly from this last.
These general terms and conditions of sale govern exclusively the sale of products offered on our
site. They are systematically accessible on the present site by the purchaser when the order is
placed. Consequently, the act of placing an order implies the buyer's full and unreserved
acceptance of these terms and conditions of sale. In the absence of express acceptance by the
buyer, any condition to the contrary will be unenforceable against the seller, regardless of when it
may have been brought to the seller's attention. The fact that the seller does not avail itself at a
given time of any of the present general conditions of sale may not be interpreted as a waiver of
the right to avail itself of any of the said conditions at a later date.
Prior to placing an order, the Buyer declares that he/she has full legal capacity, enabling him/her
to commit to the present terms and conditions of sale.
In accordance with the provisions of articles 1316 to 1316-4 of the French Civil Code,
supplemented by Decree n° 2001-272 of March 30, 2001, taken for the application of article
1316-4 of the Civil Code and relating to the electronic signature, it is recalled that the validation
of the order form as specified in article 3 below, constitutes an electronic signature which has,
between the Parties, the same value as a handwritten signature.
Impasse des parfums reserves the right to modify these terms and conditions of sale at any time.
In this case, the applicable conditions will be those in force at the date of the buyer's order.
2. PRODUCTS AND PRICES
2.1. PRODUCTS
In accordance with Article L. 111-1 of the French Consumer Code, the User may, prior to placing
an order, review the essential characteristics of the product(s) he/she wishes to order on the
Impasse-des-parfums website.
All product offers on the Site are limited to Metropolitan France, Corsica and Monaco.
Promotional offers are only valid for the duration of the offer and while stocks last.
2.2. PRICE
The sale prices of products on our website are indicated in euros, inclusive of all taxes, and are
those in force at the time of registration of the order form by the Buyer.
They do not include shipping and order processing costs, which are invoiced in addition to the
price of the products purchased, depending on the amount of the order. Shipping costs will be
indicated before the Buyer places the order.
The selling prices of products may be modified by Impasse des parfums at any time. The Buyer
will be informed of any such changes before placing an order.
The products remain the sole property of Impasse des parfums until full payment has been received
by Impasse des parfums.
3. ORDER REGISTRATION AND VALIDATION
The User may view the various Products offered for sale by Impasse des parfums on its Site.
The User may browse freely through the various pages of the Site, without being bound by any
order.
The User is responsible for all telecommunication costs incurred when accessing the Internet and
using the site.
Any order implies unreserved acceptance of these terms and conditions of sale.
When you confirm your order by clicking on the "confirm" button, you declare that you accept the
order and these terms and conditions in full and without reservation. Your order is then processed
so that you can receive your parcel. You can print out your order form. As soon as your order has
been registered, a detailed acknowledgement of receipt will be sent to your email address. This
acknowledgement will specify the exact amount invoiced and the delivery terms of your order.
This acknowledgement constitutes acceptance of your order and validates the transaction. You
accept that our order registration systems are proof of the nature and date of the agreement.
However, we reserve the right to cancel any order from a customer with whom there is a dispute
over payment of a previous order.
4. PAYMENT
Payment must be made at the time of ordering. At no time may the sums paid be considered as
deposits or advance payments.
All orders are payable in euros. The Buyer guarantees Impasse des parfums that he/she has the
necessary authorizations to use the method of payment he/she has chosen, at the time of
registration of the order form.
Impasse des parfums reserves the right to suspend or cancel any order and/or delivery,
whatever its nature and level of execution, in the event of non-payment of any sum due by the
Buyer, in the event of a payment incident or in the event of an existing dispute with the Buyer.
As part of the fight against Internet fraud, information relating to your order may be transmitted
to any third party for verification.
To pay for his order, the Buyer has the following methods of payment: credit card or via the
PayPal platform.
The following credit cards are accepted on the site: Carte Bleue, Visa and Master Card.
Payments may be made by credit card; they will be made via the Stripe secure system using the
SSL (Secure Socket Layer) protocol, so that the information transmitted is encrypted by software
and no third party can gain knowledge of it during transport on the network.
In the case of payment by credit card, the buyer's account will be debited on the day the order is
placed.
5. DELIVERY AND ACCEPTANCE
Products will be delivered to the address indicated by the Buyer on the order form, a destination
which must be consistent with the previously agreed geographical area, and are understood to
be ex-Montpellier.
By default, invoices are available on the account declared by the customer during registration.
Failure to comply with the procedures set out below will result in the Buyer's claim not being
accepted.
Delivery by Colissimo is handled by La Poste. In case of absence, the Buyer or the recipient of
the ordered product receives a notice of passage from the letter carrier, which allows him to
withdraw the ordered products, at the nearest post office, during a period of fifteen days.
Deliveries with Mondial Relais and Colissimo will be made according to the rules of these delivery
companies. The Buyer is obliged to check the condition of the packaging and the contents of the
goods on delivery, in the presence of the postal employee or delivery person.
In the event that the Buyer has any doubt whatsoever as to the condition or contents of the
parcel, he/she is obliged :
to apply the deliveryman's procedure (in particular to report any damage due, any complaints
and reservations) and to refuse the goods by immediately issuing a statement of anomaly to the
deliveryman or collection point.
to report such incidents within 48 hours via our website, specifying the order number.
Delivery times, following validation of your order, are for France, 3 to 5 working days.
Orders confirmed before 12pm, Monday to Friday (excluding public holidays), are generally
processed the same day, subject to availability. Orders confirmed between Friday 12am and
Sunday evening are generally processed the following Monday (except public holidays).
Products are offered while stocks last. In the event of unavailability of one of the Products, the
Buyer will be informed as soon as possible.
The Buyer may cancel the order by requesting a refund of the sums paid within thirty (30) days
of their deduction via our website.
6. RIGHT OF WITHDRAWAL
In accordance with article L. 121-20 of the French Consumer Code, the Buyer has a period of 14
clear days from the date of receipt to return the products ordered for reimbursement, at his or
her own expense.
Products must be returned to Impasse des parfums, 610 rue Alfred Nobel, 34000 Montpellier , in
perfect condition for resale, in their original state (packaging, accessories, instructions...), duly
sealed.
When a buyer returns products, all risks related to the return of the product are the responsibility
of the buyer. Impasse des parfums will not accept packages sent postage due.
In the absence of compliance with the above procedure and deadlines, the purchaser will not be
entitled to make any claim for non-conformity or apparent defect of the products delivered, the
products being deemed to be in conformity and free of any apparent defect.
7. RESALE BAN
It is forbidden to buy our products for resale, especially on websites or geographical sites.
8. RETENTION OF TITLE
Impasse des parfums retains full and complete ownership of the products sold until full payment
has been received, in principal, costs and taxes included.
9. RESPONSIBILITY
Impasse des parfums cannot be held responsible for the non-execution of the contract in the
event of stock shortage or unavailability of the product due to a case of force majeure, disruption
or total or partial strike in particular of the postal services and means of transport and/or
communications. The products offered comply with c u r r e n t French legislation.
Impasse des Parfums reminds you that any creation of a hypertext link to this Site is subject to the
express, prior and written agreement of Impasse des Parfums.
If one or more stipulations of these general terms and conditions of sale are held to be invalid or
declared as such in application of a law, regulation or following a final decision by a competent
court, the other stipulations will retain all their force and scope.
The fact that one of the parties does not avail itself of a breach by the other party of any of the
obligations referred to in these terms and conditions of sale shall not be construed as a waiver of
the obligation in question for the future.
In the event of disputes or litigation arising from or in connection with a contract concluded
between Impasse des parfums and the Customer, they may be resolved by
mediation/conciliation.
In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, the processing of
personal data collected on the Site has been declared to the French Data Protection Authority
(Commission Nationale de l'Informatique et des Libertés). The User has the right to access,
modify, rectify and delete data concerning him or her. To exercise this right, the User should send
a letter to Customer Services, Impasse des Parfums, 610 rue Alfred Nobel, 34 000, Montpellier,
France.
10. INTELLECTUAL PROPERTY
All elements of the Impasse des parfums site are the exclusive intellectual property of Impasse des
parfums. Nobody is authorized to reproduce, exploit, rebroadcast, or use for any reason
whatsoever, even partially, elements of the site whether software, visual or sound.
The reproduction or use of all or part of these elements is authorized solely for the purposes of
information for personal and private use, any reproduction and any use o f copies made for other
purposes being expressly prohibited. Any other use constitutes an infringement and is punishable
under the Intellectual Property Code, unless prior written authorization has been obtained from
Impasse des Parfums.
11. APPLICABLE LAW AND JURISDICTION
Sales of products by Impasse des parfums are subject to French law. The language of the present
contract is French.
Any dispute relating to the interpretation, performance or breach of the contract concluded
between Impasse des parfums and the Buyer, even in the event of multiple defendants, will, in the
absence of amicable agreement, fall under the exclusive jurisdiction of the French courts.
